Been Served with a Mechanics Lien, Now What?
We will need to bring a special proceeding, and quick. Generally, the time for the vehicle to be sold or redeemed is ten days--and unscrupulous garages bank on the fact that you'll be working to try to figure out what to do in order to not lose your car. Or even worse, they hope you'll pay the fee.
Very often garages will dupe you into having your car towed to its shop and then when you're quoted a price that is either out of the budget or even worse, just plain out predictory and you decline the garages will charge you storing, or attempt to. This often happens to those hoping insurance will pay. It's a literal, legalized, scam.
Hire an Attorney, and Quick
Because the challenges to a mechanics lien and either be facial (on the face of the lien document), or by facts (the circumstances)--to challenge a lien is filed by special proceeding. If you've been served with a NY DMV notice of lien sale by a garage, you have ten days to file the special proceeding and you need the experience of a New York attorney to file and serve the challenge.
Generally, because fighting the mechanic's lien is done by special proceeding the matter can usually be resolved within as little as one to six months as opposed to otherwise lengthy litigation.
